Erica Herman, the ex-girlfriend of Tiger Woods, is not giving up in her legal battle against the star golfer after it was rejected in a Florida court.

Herman is reportedly filing an appeal, extending his case in which he accuses Woods of sexual harassment following their October 2022 breakup.

The resource, according to USA Today Sportswas filed Friday before the Court of Appeals for the Fourth District in Florida.

Herman’s lawsuit wants her released from the non-disclosure agreement she allegedly signed with Woods in 2017. The judge who rejected her lawsuit said twice that because of the NDA, he had to settle her lawsuit in private.

Herman’s attorney, Benjamin Hodas, filed a request for reconsideration last Wednesday.

«The US Supreme Court has always held that a party cannot be compelled to arbitrate without a finding that they agreed to arbitrate, which means that in this case, without evidence on the record, there is no arbitration must be compelled or, at a given moment, at least, an evidentiary hearing must be held”, indicates the document presented by Hodas.

Hodas questions the NDA, while Herman noted that he «has no recollection of signing it,» according to USA Today Sports. However, Judge Elizabeth Metzger, who rejected the lawsuit and the reconsideration, said Herman never denied signing one.

«Herman has had the opportunity (to) provide factual specificity for any claim related to sexual assault or sexual harassment, however, he has not done so,» Metzger wrote in his 11-page opinion.

Court records indicate that Herman says Woods had a sexual relationship with her while he was employed by her. Then she was forced to sign an NDA or Woods threatened to fire her from her job.

Metzger told Hodas that more information was needed on the matter, but Hodas feared that the NDA would be violated.

Had Herman denied signing the NDA, he conceded that a hearing would have been ordered on the issue.

Woods’ attorney, JB Murray, said all the allegations are «absolutely baseless.»
